Nevada Dog Bite Laws

Unlike most states, Nevada has no established laws regarding dog bite liability. It is determined by common law, which can leave things unclear.

For the most part, dog bite responsibility is based on the dog’s previous behavior. Does it have a record of aggression? If a dog has bitten someone before, the owner is typically held liable for any further incidents. This is because if a dog has previously bitten someone, the owner is expected to assume the dog has a history of aggression or violence. If the owner ignores the fact that their dog has a history of aggression, they can be held liable for a dog bite.

When it comes to determining negligence, Nevada follows the rule of comparative liability. This means you cannot be more than 50% responsible for your injuries. If you are, then you will be unable to file a claim and pursue compensation for your damages.

If you are eligible to file a claim, don’t delay. Nevada’s statute of limitations is two years and begins on the day the dog attacked you. Once you miss this deadline, you will be barred from filing a claim.

Degrees of Dog Bites

There are six degrees of dog bites:

  • Level 1. This is the least severe bite, with no direct contact between the dog’s teeth and the person’s skin.
  • Level 2. There is contact with the skin, but it’s not punctured.
  • Level 3. This bite will leave 1-4 tooth punctures in the skin from a single bite, although none are deeper than half the depth of the dog’s canine teeth. This is a sign of aggression.
  • Level 4. At least one of the punctures will be deeper than half the length of the dog’s canine teeth. The dog should not be around people.
  • Level 5. These bites often signify that a dog has bitten before. Euthanasia is often recommended.
  • Level 6. The severity of this bite results in a fatality.
